Complaints & Discipline
Dental health professionals facing an allegation of professional misconduct, incompetence, incapacity or impairment may lose their reputation, livelihood and career. A complaint made by a member of the public, or a colleague, can be referred to a hearing. Joyce Weinman represents health professionals before their Regulatory Colleges.
The health professional must make a full answer and defence to the allegations.
Joyce Weinman will:
- Review the complaint to ensure it was correctly referred to a hearing
- Prepare a written response with input from the member
- Review the disclosure of the College’s case
- Assess the merits of the case against the member
- Gather evidence and review records of the member to reply to the allegations
- Attend in your office to interview staff or conference call with staff members
- Negotiate the withdrawal of some or all of the allegations and negotiate a resolution of the allegations
- Review the prosecutor’s pre-hearing brief, prepare the member’s pre-hearing brief and attend with the member to make submissions before the presiding officer
- Negotiate undertakings which can reduce days lost from practice
- Address preliminary matters at motions, move to dismiss or limit the allegations against the member
- Prepare and attend at the hearing on behalf of the member
- Make submissions on reasonable penalty if a finding against the member is made
- Advise on the merits of an appeal if an unfavourable decision is made
